Tencent and Sony agreed to postpone the hearing until 2026 and proposed a new date of January 15. Judge Jacqueline Scott Corley is expected to make a decision on the request in the coming weeks, depending on availability for trial. The parties cited two reasons for the delay. First, Tencent requested more time to respond to the request for a preliminary injunction. Motiram's Light; Second, Sony's lead attorney, Annette Hurst of Orrick, Herrington & Sutcliffe, will be unable to attend the original date because she is scheduled to represent Microsoft at a discovery hearing related to an AI copyright lawsuit recently filed by The New York Times Company.

Citing these examples, Tencent assumes that character representation depends on repetition being specifically and consistently identified. It uses this to argue that Sony has not locked down a single protectable Aloy image that functions as a trademark outside of the game. The brief notes that generalized descriptions such as “attire, accessories and facial markings” (or an undefined “silhouette”) are too vague to describe a single marking and that the in-game character status itself does not establish trademark use.
