The tariffs enacted by the Trump administration in 2025 are currently mostly closed after the Supreme Court declared the IEEPA tariffs unconstitutional. Afterwards, a method was presented for companies to claim a refund of customs costs, and this is where a new lawsuit against Sony begins in earnest.

Now, a new class action lawsuit has been filed against Sony, claiming the company is reaping a “significant windfall from illegal tariffs.” In other words, the suit alleges that Sony raised the price of the PlayStation 5 to compensate for the tariffs, and is now due to receive tariff rebates from the government, but is not passing them on to consumers who paid extra for the PlayStation console during that period. If accurate, this means Sony is benefiting twice from the increased prices and tariff rebates for its PlayStation 5 console family. The lawsuit alleges that all consumers who purchased PlayStation 5 consoles at increased prices after the introduction of the tariffs should be refunded the additional costs.

Sony has been the target of numerous lawsuits in recent years, even before the tariffs took effect. In other words, this problem isn't limited to Sony or video game and console manufacturers. Nintendo is also facing a tariff lawsuit for much the same reason. This indicates that Nintendo will have to give consumers the money they get back as tariff refunds. Amazon, Nike, and Adidas are currently being sued for the same reasons, and shipping companies like UPS and FedEx, which are facing legal threats, have pledged to provide tariff refunds to affected customers.

At this point, it remains to be seen how Sony will respond to the lawsuit and whether players will eventually be able to get their money back.
