To obtain Ace the Bat-Hound, you must purchase the Deluxe Edition upgrade. It's important to know that you can only get Ace the Bat-Hound if you have the Batman Beyond pack, and Ace is non-playable.

How to get Ace the Bat-Hound in LEGO Batman: Legacy of the Dark Knight

If you have the Deluxe Edition upgrade, you can go to the Batcave (starting with Chapter 2). Opposite the gadget upgrade station in the Batcave is a platform where you can place trophies. Approach this station and press Up on the D-Pad, then Square/X to enter your inventory.

Use R1/RB to go to the second-to-last tab (it has a trophy icon). In the first row you will find the Bat-Hound Doghouse. Once selected with X/A, you can place them anywhere on the LEGO board. Now exit the customization menu and press Triangle/Y in the Bat-Hound Doghouse to pet and interact with Ace!
